Sub: Payment of wages to Contract labourers- Chennai High court order- Reg.

We are very much pleased to convey our gratitude to your good office for verification of bank accounts and settlement of pending wages to the nearly 5000 workers in accordance with Chennai High court orders. We are all aware that this could be achieved only‌with commitment to the welfare of the down trodden workers for which we are once again communicating our thanks to your team under your able guidance.

In this connection we would like to point out‌ that there are some important issues to be resolved along with this subject:-

1. As per your affidavits submitted before Chennai High Court , it is noticed that payment have been made to the tune of nearly 35 crores rupees to totally 4759 workers However there is serious problem in calculation of Due wage amount for many contract workers. You are all aware that BSNL administration is not sincere and helpful in settlement of wages. They are not properly maintaining proper labour records, daily wage particulars. In short they are not bothering about Indian Labour laws. It is regretted to inform that Shri C. Vinodkumar, General secretary of Our Union who has filed the case has been denied his eligible wages. He has been given only Rs.83798/- instead of actual dues of Rs. 2,56,429/- (upto 31.10.2020) . Alongwith Sri.C.Vinodkumar, General Secretary more than 1000 workers have been denied their due wages. We are doubting that BSNL has gone on vindictive action against our Circle Secretary and Leading Union functionaries for filing the case in the Court of Law. It is requested that your good office may intervene and arrange for recalculation of due wages and pay them their due amount.

2. The Chennai High court has ordered to pay ALL the pending dues of the workers vidde orders dated 10.12. 2020, 22.03.2021, 09.04. 2021, 21.04.2021 etc. Even though the payment has been made to the workers, it is not officially informed either to the Workers or Union about the period upto which payment has been made. It is gathered that there are some month wages are left out. Even the court has ordered to settle all the pending dues, it is not known for non payment for certain months. Being the downtrodden workers, the contract labourers could not file cases in the Court of Law for getting their wages then and there. Hence the BSNL may suitabley be instructed to settle ALL the dues upto this date. 

3. It is needless to mention that every worker is entitled to get the wage particulars of every month as per Indian labour laws from the employer. It is requested that these particulars may be supplied to the labourers either by the employers or by principal employers.

It is informed in the last court order that the petition is going to be disposed off with the next gathering .i.e. 28.04. 2021, it is requested that a copy of wage paid particulars from your good office may be supplied to our Union for our records.
